Terms of Service

1. Acceptance of terms

By accessing Foretide World (the "Service"), operated by Maistik Studio, you agree to these Terms. If using the Service on behalf of an organisation, you represent authority to bind that organisation. If you do not agree, do not use the Service.

2. Description of the Service

Foretide is an AI-powered prediction platform that builds multi-agent simulations from user-uploaded documents. The Service includes: document upload and processing, temporal knowledge graph construction, multi-agent simulation across configurable environments, AI-generated intelligence reports, and interactive conversational analysis. Supported file formats: PDF, Markdown, and plain text.

3. Account responsibilities

You are responsible for: maintaining credential confidentiality, all activities under your account, providing accurate information, and notifying us immediately of unauthorised use. We may suspend accounts for suspected security breaches.

4. Acceptable use

You agree NOT to: upload illegal, defamatory, or infringing content; use the Service for high-risk automated decisions (hiring, credit, law enforcement) without human oversight; generate content that promotes violence, discrimination, or harm; impersonate others or misrepresent affiliation; attempt to circumvent security, access controls, or rate limits; reverse-engineer, decompile, or extract source code; use the Service to compete with Foretide; violate any applicable law or regulation.

5. Intellectual property and AI output ownership

(a) Your content — you retain all rights to documents you upload. (b) AI-generated outputs — you own the simulations, reports, predictions, and knowledge graphs generated from your content. (c) Foretide rights — we retain ownership of the platform, algorithms, features, and underlying technology. (d) Limited licence — by uploading content, you grant us a limited, non-exclusive licence to process it solely to provide the Service. (e) No training — we do not use your content or outputs to train AI models. (f) Feedback — any voluntary feedback about Foretide may be used to improve the Service without obligation.

6. AI limitations and responsible use

IMPORTANT: AI predictions are probabilistic estimates, not guarantees. (a) Accuracy — simulations may be incorrect, incomplete, or misleading. Do not rely solely on Foretide outputs for critical decisions. (b) Bias — AI models may reflect biases in training data or user-provided documents. (c) Non-determinism — identical inputs may produce different outputs across simulations. (d) Data quality — output quality depends on input quality. Incomplete or biased data produces lower-quality predictions. (e) Your responsibility — validate AI outputs against other sources, document limitations when sharing predictions, ensure human review for high-stakes decisions, and comply with applicable laws including the EU AI Act when using predictions.

7. Credits and billing

The Service operates on credits consumed by AI operations. (a) Monthly credits reset on the first of each calendar month and do not carry over. (b) Bonus credits purchased separately do not expire until account closure. (c) Upon downgrade or cancellation, remaining monthly credits are forfeited. (d) Billing disputes must be raised within 30 days to billing@foretide.world. We investigate within 10 business days. (e) Refund policy — monthly subscriptions are non-refundable for unused time. Bonus credit purchases are non-refundable except where required by consumer protection law. (f) Suspension — we may suspend access for non-payment. Data remains accessible for 30 days after suspension; after that, data may be permanently deleted.

8. Disclaimers and warranties

THE SERVICE, INCLUDING ALL AI PREDICTIONS, SIMULATIONS, AND REPORTS, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. FORETIDE DISCLAIMS ALL WARRANTIES INCLUDING: merchantability, fitness for a particular purpose, non-infringement, accuracy or reliability of AI predictions, uninterrupted or error-free service, that simulation outputs reflect real-world outcomes, and compatibility with your specific use case. No information or advice obtained from Foretide creates any warranty not expressly stated herein.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) Foretide shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, business interruption, or damages arising from reliance on AI predictions. (b) Our total aggregate liability shall not exceed the amount you paid in the 12 months preceding the claim. (c) These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise). (d) Nothing in these Terms limits liability for death, personal injury from negligence, fraud, or any liability that cannot be excluded by law.

10. Indemnification

You shall indemnify, defend, and hold harmless Foretide, Maistik Studio, and their officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your violation of these Terms or applicable laws; (b) content you upload infringing third-party intellectual property rights; (c) your misuse of the Service or AI-generated outputs; (d) claims arising from decisions made based on AI predictions; (e) your breach of representations and warranties herein.

11. Availability and SLA

We target 99.5% monthly uptime, excluding scheduled maintenance. Scheduled maintenance windows are communicated 48 hours in advance via email and status page. If monthly uptime falls below 99%, affected customers receive service credits of 10% of that month's fees. We are not responsible for outages caused by third-party providers, force majeure events, or user-side connectivity issues.

12. Force majeure

Foretide shall not be liable for failure to perform obligations due to circumstances beyond reasonable control, including: third-party AI provider outages or discontinuation, data centre failures, government actions, natural disasters, pandemics, sanctions or export controls, internet infrastructure failures, or payment processor outages. We will provide notice and seek reasonable alternatives.

13. Termination

Either party may terminate at any time. Upon termination: (a) you may export your data in standard formats (PDF, JSON, CSV, Markdown) within 30 days; (b) we delete your data within 30 days of account closure, except where retention is required by law; (c) all credits (monthly and bonus) are forfeited and non-refundable; (d) sections on IP, liability, indemnification, and governing law survive termination.

14. AI regulatory compliance

Foretide is designed as a general-purpose simulation and business intelligence tool. It is NOT intended for: biometric identification, law enforcement or criminal justice decisions, employment hiring or promotion decisions, credit or insurance risk assessment, or access to essential public services. Users must ensure their use case complies with applicable AI regulations including the EU AI Act. Foretide maintains documentation on system design and known limitations, available upon request.

15. Governing law and dispute resolution

(a) These Terms are governed by the laws of Spain and the European Union. (b) Disputes shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain. (c) For data protection disputes, you may also file a complaint with the Spanish Data Protection Authority (AEPD) at www.aepd.es. (d) Before litigation, parties agree to attempt good-faith negotiation for 30 days. (e) Nothing prevents either party from seeking injunctive relief in any jurisdiction.

16. Changes to these terms

We may update these Terms with at least 30 days' email notice before material changes take effect. Continued use after the effective date constitutes acceptance. If you disagree with changes, you may terminate and export your data before they take effect.
